Defra has clarified how grant aid will be made available under the Land Drainage Act 1991 and Coast Protection Act 1949.

Flooding from the sea will be under the Land Drainage Act and therefore classed as flood risk management, whilst coastal erosion will continue as defined in the Coast Protection Act as protection against erosion.

There may be locations where it is unclear which legislation should be used and in these cases it will be determined on the basis of which element provides the majority of the benefits.
